1. Introduction

These Terms & Conditions govern your use of the Simply Wigs website and all purchases made from Simply Wigs Limited. By accessing our website, placing an order, or creating an account, you confirm that you have read, understood and agree to be bound by these Terms & Conditions.

These Terms should be read alongside our Delivery Information, Returns & Refunds Policy, Privacy Policy, Cookie Policy and VAT Relief Information, all of which form part of these Terms where applicable.

Nothing in these Terms excludes or limits your statutory rights under UK consumer law.

You agree to use our website lawfully and responsibly. You must not:

  • misuse the website or interfere with its operation;
  • attempt unauthorised access to our systems or customer accounts;
  • introduce viruses, malware or other harmful software;
  • copy, reproduce or distribute our content, photographs, logos or branding without our written permission;
  • use our website in any way that breaches applicable law.

All intellectual property rights remain the property of Simply Wigs Limited or our licensors.

4. Customer Accounts and Passwords

You may create an account when placing an order or at any time through our website. You are responsible for keeping your account details and password confidential and for all activity carried out using your account.

If you believe your account has been accessed without your permission, please notify us as soon as possible.

We reserve the right to suspend or close any customer account where we reasonably believe it has been used fraudulently, unlawfully or in breach of these Terms & Conditions.

5. Communications

We may contact you by email or telephone regarding your order, payment, delivery, returns, VAT Relief claims or any other matter relating to your purchase.

Where we reasonably believe it is necessary to provide the best possible service, we may also contact you to clarify your requirements before processing an order, including where we need to discuss product availability, order quantities or other order-related queries.

It is your responsibility to ensure that the contact details you provide are accurate and up to date.

6. Breaches of These Terms & Conditions

If we reasonably believe that you have breached these Terms & Conditions, we reserve the right to take appropriate action, including:

  • issuing a warning;
  • refusing or cancelling an order;
  • suspending or closing your customer account;
  • restricting or blocking access to our website;
  • removing any content you have submitted to our website; and/or
  • taking legal action where appropriate.

Any action taken will be proportionate to the nature and seriousness of the breach.

7. Products & Product Information

We make every effort to ensure that product descriptions, images, colours and specifications are accurate. Colours may vary depending on your device. We may periodically change the products available on our website, and we do not undertake to continue to supply any particular product, or type of product.

Customers should follow the care and maintenance instructions provided with the product. Failure to do so may affect the product's condition and any assessment of a reported fault.

Our website does not operate a live stock system. Product availability is therefore subject to confirmation. If a product is unavailable, we will contact you by telephone or email to offer an alternative product, advise you of expected availability or provide a full refund.

We reserve the right to correct errors relating to product descriptions, pricing or availability at any time before dispatch.

8. Pricing

All prices are shown in Pounds Sterling (£) and are stated both inclusive and exclusive of VAT, where applicable.

If a genuine pricing error is identified before dispatch, we reserve the right to cancel the order. If this happens we will contact you and offer the opportunity to proceed at the correct price or receive a full refund.

Promotions and prices may change without notice but will not affect orders already accepted.

9. Payments & Chargebacks

Payment is taken in full when you place your order. We accept the payment methods displayed during checkout. All payments are processed securely. We reserve the right to refuse or cancel an order where payment cannot be authorised or where fraudulent activity is suspected.

If a payment is declined, reversed, disputed or subject to a chargeback after goods have been despatched, we reserve the right to investigate the claim, recover any sums due and, where appropriate, take reasonable steps to recover the goods or outstanding balance.

Where a chargeback or payment dispute is raised incorrectly, we may provide relevant order, delivery and communication records to the payment provider or card issuer to support our response.

Refunds will be made in accordance with our Returns & Refunds Policy and, where possible, to the original payment method.

10. Gift Vouchers

Gift vouchers are valid for 12 months from the date of purchase unless otherwise stated and are non-refundable and cannot be exchanged for cash.

Gift vouchers may be redeemed against eligible products sold by Simply Wigs. If the value of your purchase exceeds the value of the gift voucher, you must pay the difference using another accepted payment method.

If the total value of your purchase is less than the value of the gift voucher, no cash refund or credit will be given for any unused balance.

Where goods purchased using a gift voucher are returned in accordance with our Returns & Refunds Policy, the refunded amount will be credited to a replacement gift voucher or discount code, allowing it to be used again. No cash refund will be given in place of the gift voucher value.

Simply Wigs reserves the right to refuse, cancel or invalidate a gift voucher where we reasonably suspect fraud, misuse or unauthorised activity.

11. Order Acceptance

When you place an order with Simply Wigs, you are making an offer to purchase the selected products. An order acknowledgement confirms that we have received your order but does not constitute acceptance. A contract is formed when your order has been despatched.

We reserve the right to refuse or cancel an order where:

  • a product is unavailable;
  • payment cannot be authorised;
  • pricing or product information is incorrect;
  • we reasonably suspect fraudulent or unlawful activity; or
  • we are unable to fulfil the order for any other legitimate reason.

Excessive Returns: We aim to provide an excellent service to all customers. Where we identify a pattern of excessive or repeated returns, we may contact you to discuss alternative options, such as a personalised fitting appointment at our retail shop. We reserve the right, at our reasonable discretion, to refuse future orders where we believe our returns policy is being misused or where continued trading is no longer commercially viable.

12. Order Quantities

To help customers select the most suitable products and to maintain the quality of our personalised service, we generally recommend ordering no more than three wigs in a single order.

If an order contains more than three wigs, we may contact you to discuss your requirements before processing or despatching the order. This allows us to ensure that the products ordered are appropriate for your needs and to minimise unnecessary returns.

We reserve the right to delay processing an order while we contact you and, where we reasonably consider it necessary, to refuse or cancel an order containing more than three wigs. Where an order is cancelled before despatch, any payment taken will be refunded to the original payment method.

This recommendation applies to wigs only and does not restrict the quantity of accessories or other non-wig products that may be ordered.

13. Order Cancellations

You may request to cancel your order before it has been despatched.

Whilst we will make every reasonable effort to cancel your order, we cannot guarantee that a cancellation request can be processed once your order has entered our warehouse fulfilment process. When an order is marked as ‘In Progress’, it is being picked, packed and prepared for despatch. At this stage, the order may no longer be capable of being intercepted, even if it has not yet been collected by our delivery partner.

If we are able to cancel your order before it has entered the despatch process, any payment taken will be refunded to your original payment method.

If we are unable to stop your order before despatch, you may return the goods to us in accordance with our Returns & Refunds Policy and your statutory rights.

14. Delivery

Our Delivery Information page forms part of these Terms & Conditions.

It includes details of:

  • UK and international delivery services;
  • delivery charges;
  • express delivery;
  • dispatch and delivery times;
  • delivery restrictions;
  • import duties and taxes;
  • international delivery conditions; and
  • products that cannot be shipped internationally.

Delivery times begin once your order has been despatched from our warehouse and does not include order processing time.

15. Returns & Refunds

  • your 14-day consumer cancellation rights;

  • wigs and hairpiece return conditions;

  • refunds.

Purchases made in our retail shop are subject to our separate Shop Returns Policy which is displayed in our shop, and can be found within our separate Returns & Refunds Policy.

16. Consumer Rights

Nothing in these Terms & Conditions excludes, limits or affects your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or any other applicable consumer protection legislation.

17. Faulty Products

If you believe a product is faulty, not as described or not of satisfactory quality, please contact our Customer Services team as soon as reasonably possible.

Faulty products will be assessed and dealt with in accordance with your statutory rights under the Consumer Rights Act 2015. Full details of our process, including how to report a fault, inspection requirements, available remedies and return postage arrangements, are set out in our Returns & Refunds Policy.

18. VAT Relief

Customers purchasing a wig or hairpiece for medical reasons may be eligible for VAT relief. To claim VAT relief, you must complete a VAT Relief Declaration during checkout or request a declaration form by post.

Full eligibility information is available on our VAT Relief Information page. Providing false information on a VAT Relief Declaration may constitute an offence under HMRC regulations.

19. Price Match Guarantee

Simply Wigs may match the advertised price of an identical product sold by another UK retailer.

Price Match requests are considered at our discretion and are subject to the following conditions:

  • the product must be identical;
  • the retailer must be based in the UK;
  • clearance, closing down, auction, marketplace and overseas offers are excluded;
  • where a competitor's product is non-returnable or subject to a returns charge, the same conditions will apply to the matched purchase from Simply Wigs.

Price Match discount codes are valid for 72 hours only.

The Price Match Guarantee may be suspended or amended during selected promotional events including Black Friday and other major sales.

20. Promotions & Discount Codes

From time to time we may offer promotional discounts, voucher codes or special offers.

Unless stated otherwise:

  • only one discount code may be used per order;
  • promotional discount codes are non-transferable and may only be used by the person to whom they were issued;
  • discount codes cannot be exchanged for cash;
  • promotions may be withdrawn or amended without notice;
  • discount codes issued as part of a promotion are valid only in accordance with the terms of that promotion. They cannot be used against any of our Big Brand sales.
  • Simply Wigs reserves the right to amend, suspend or withdraw any promotion at any time.

Where a qualifying order is cancelled or returned, any promotional discount code issued for that purchase may be reactivated at our discretion where the promotion allows.

21. Special Orders

Some products are specially ordered from our suppliers at your request.

Special order items:

  • are subject to supplier availability;
  • may take longer to arrive than standard stock items; and
  • cannot normally be cancelled or returned once ordered unless they are faulty or supplied in error.

22. Customer Content & Promotions

Customers may submit photographs, videos or personal stories about their experience with Simply Wigs for possible use on our website, social media and other marketing materials. Submission of content does not guarantee that it will be published.

Where you have provided your consent, you grant Simply Wigs a non-exclusive, royalty-free licence to use, reproduce, publish and display your content for promotional and marketing purposes.

Our current promotions include:

  • Send us a Selfie – Submit a photograph of yourself wearing your Simply Wigs purchase and, if approved, receive a 15% discount code for a future order.
  • Write Your Story – Share your Simply Wigs journey and, if approved, receive a 30% discount code for a future order.
  • Video Reviews – Promotional offers for video reviews may be available from time to time. Details of any current offer will be published on our website.
  • Promotional discount codes are valid for one use only. If the qualifying order is cancelled by Simply Wigs before despatch, the code may be reissued. If a qualifying order is returned, replacement of the promotional code is at Simply Wigs’ discretion.
  • Only one promotional discount code will be issued for each approved entry unless otherwise stated.
  • Promotional discount codes are valid for 3 months from the date of issue, unless otherwise stated.
  • Simply Wigs reserves the right to decline or remove any content that is unlawful, offensive, misleading, infringes the rights of others or is otherwise unsuitable for publication.
  • Simply Wigs reserves the right to amend, suspend or withdraw any promotion at any time.

23. Intellectual Property

All website content, including text, photographs, graphics, logos, videos, product descriptions and branding, is owned by or licensed to Simply Wigs Limited.

You may view, download and print content for your personal, non-commercial use only. You must not copy, reproduce, distribute, modify or otherwise use any content without our prior written permission. Any unauthorised commercial use may result in legal action.

24. Privacy & Cookies

We are committed to protecting your privacy and handling your personal information responsibly. Our Privacy Policy and Cookie Policy explain how we collect, use, store and protect your personal information and form part of these Terms & Conditions.

25. Third-Party Websites

Our website may contain links to third-party websites for your convenience.

These websites are not owned or controlled by Simply Wigs, and we are not responsible for their content, availability, privacy practices or terms of use.

Accessing third-party websites is at your own risk, and you should read their own terms and policies before using them.

26. Website Accuracy and Availability

We make every reasonable effort to ensure that the information on our website, including product descriptions, images, pricing and availability, is accurate and up to date. However, errors may occasionally occur, and we reserve the right to correct any errors or update information without prior notice.

Product images are for illustrative purposes only. Colours may vary depending on your device or screen settings.

Whilst we aim to keep our website available at all times, we cannot guarantee uninterrupted or error-free access. We may suspend, withdraw or amend any part of the website where reasonably necessary for maintenance, security or operational reasons.

27. Limitation of Liability

Nothing in these Terms and Conditions excludes or limits our liability where it would be unlawful to do so. This includes liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • any rights you have under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.

Subject to the above, we shall not be liable for any indirect or consequential loss arising from your use of our website, products or services where such limitation is permitted by law.

We are not responsible for loss or damage resulting from the misuse of a product, incorrect fitting, unauthorised alterations, cutting, colouring, excessive heat styling, or failure to follow the manufacturer’s care instructions. This does not affect your statutory rights where a product is faulty or not as described.

Our total liability to you in relation to any claim arising from your purchase of products or services shall not exceed the total amount paid for the relevant order, except where the law provides otherwise.

28. Events Beyond Our Control (Force Majeure)

We shall not be liable for any delay or failure to perform our obligations where this is caused by circumstances beyond our reasonable control, including but not limited to:

  • severe weather;
  • industrial disputes;
  • supplier or manufacturer delays;
  • transport disruptions;
  • failure of utilities or communication networks;
  • government action; or
  • any other event outside our reasonable control.

Where possible, we will keep customers informed and resume normal service as soon as reasonably practicable.

29. Changes to These Terms

We may amend these Terms & Conditions from time to time to reflect changes in legislation, our business practices or our website. The latest version will always be published on our website and will apply to orders placed after the revised Terms have been published.

30. Assignment

We may assign, transfer, subcontract or otherwise deal with our rights and obligations under these Terms and Conditions, provided that doing so does not reduce any of your statutory or contractual rights.

You may not assign, transfer or otherwise deal with any of your rights or obligations under these Terms and Conditions without our prior written consent.

31. Severability

If any provision of these Terms and Conditions is found by any court or other competent authority to be unlawful, invalid or unenforceable, that provision shall be deemed severed from the remaining Terms and Conditions. The remaining provisions shall continue in full force and effect.

32. Third-Party Rights

A person who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these Terms and Conditions.

33. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Cookie Policy and any documents expressly referred to within them, constitute the entire agreement between you and Simply Wigs Limited in relation to your use of our website and the purchase of our products and services.

34. No Waiver

If we delay or fail to enforce any provision of these Terms and Conditions, this shall not constitute a waiver of our right to enforce that provision or any other provision at a later date.

35. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any dispute arising from the use of our website or the purchase of our products shall be subject to the exclusive jurisdiction of the courts of England and Wales.
